OPT OUT
SUPPRESSION FILE
The mailer must provide an opt out file, of email addresses only,
in text, excel or access format for every order. If the mailer has
a domain suppression file this must be provided as a separate file.
If the mailer does not have an opt out file the mailer must sign
an addendum stating they understand they are liable under the new
law. If the same mailer rents the file a second time they must provide
an opt out list, no exceptions.
OPT OUT
MAILER LINK
The mailer must now include a clear and conspicuous Internet-based
mechanism for recipients to request not to receive future advertisements
or promotions from the brand promoted and presented in the message,
(mailer opt out). The mailer opt out link must be conspicuously
included on the first screen, preferably inserted by the mailer
upon message creation. If not "pre-inserted" into the
message the mailer must provide the opt out URL and the list owner
will put the mailer opt out in the footer along with opt out instructions.
The list owner will also include an opt out to third party offers
in addition to the mailers opt out.
OPT OUTS
Must be removed from commercial email campaigns from advertiser
within 10 business days. Opt out mechanism must be functional for
a minimum of 30 days after message transmission.
POSTAL ADDRESS
The mailer must include a valid physical postal address in a clear
and conspicuous manner in the content of every message. A PO Box
or mail drop does not suffice. The Postal Address must be that of
the advertiser.
FROM LINE
List owners have different interpretations of who "the sender
is", as defined in the Federal Can Spam Law. Some list owners
will allow us a choice between your company/brand name, and the
publication/publisher/list name going in the From Line. Some list
owners will force us to use only one or the other. No generic or
misleading From Lines will be accepted, an email address cannot
go in the From Line.
SUBJECT
LINE
The subject line should have a direct reference to the advertisement.
It should be clear, relevant, honest and not misleading. "Teaser"
subject lines are not allowed. ADV is not required to be included
in the subject line.
MESSAGE
CONTENT
As always the message content will be subject to list owner review
and approval. Content should give clear and conspicuous identification
that the email is an advertisement or solicitation. The message
should be honest and not misleading. The advertiser of the email
is responsible for determining how to indicate that the message
is a solicitation.
